Terms of Service
Oct 13, 2026
About these terms
These terms govern your use of the advertising services and software (the "Service") provided by Snow Doughnut ("we", "us"), a marketing agency based in Canada. By granting us access to your Meta assets or using the Service, you agree to these terms.
The Service is for businesses that have engaged Snow Doughnut to set up or manage their Facebook and Instagram advertising. It is not offered to consumers. Our Privacy Policy explains how we handle personal information.
The Service
The Service connects to Meta's Marketing API through our Meta app to set up and manage advertising on your behalf. With your authorization, we may:
Create, edit, pause and report on campaigns, ad sets and ads in your ad account.
Create and manage lead forms on your Facebook Page.
Retrieve lead form submissions and deliver them to you.
Pull performance data to produce reports.
We act only on accounts you have granted us access to, and only for the purposes you have engaged us for. Unless you instruct us otherwise, campaigns we create are left paused until you or we review and activate them.
Your responsibilities
You are responsible for your Meta accounts and what is advertised through them. You agree to:
Own or have the right to use the ad account, Facebook Page and Instagram account you connect, and grant us access through Meta Business Manager.
Provide accurate business details, budgets and approvals, and tell us promptly if they change.
Make sure the products, services, claims, images and lead form questions you ask us to use are lawful and comply with Meta's Advertising Standards.
Handle the leads you receive in line with privacy law and your own privacy policy.
Tell us if your business falls into a Meta special ad category, such as housing, credit, employment or politics.
You must not use the Service to run ads that are misleading, infringe anyone's rights, or break the law or Meta's policies. We may refuse or pause any campaign we believe would do so.
Ad spend, fees and Meta's terms
Ad spend is paid by you directly to Meta through the payment method on your ad account. We do not take a percentage of your ad spend unless our agreement with you says otherwise.
Our fees for the Service are set out in your service agreement or invoice. If an invoice is unpaid when due, we may pause work until it is paid.
Your use of Facebook and Instagram advertising is also governed by Meta's Terms of Service and Advertising Standards. Meta may reject ads, restrict accounts or change its platform at any time, and we are not responsible for those decisions.
Data, access and termination
Your ad account, Page, campaigns and leads remain yours. We use them only to provide the Service, as described in our Privacy Policy.
You can remove our access at any time in Meta Business Manager, and either of us can end the Service with written notice. When the Service ends, we stop accessing your accounts, and campaigns we built stay in your ad account for you to keep, pause or delete. On request, we delete the data we hold about you within 30 days, except what we must keep for legal or accounting reasons.
Warranties, liability and governing law
The Service is provided "as is". We will carry out the work with reasonable skill and care, but we do not guarantee any particular number of leads, cost per lead, or other advertising result.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or losses caused by Meta's platform, policies or enforcement actions. Our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose.
These terms are governed by the laws of [province] and Canada, and any dispute will be heard in the courts of [province].
Changes and contact
We may update these terms from time to time. The date at the top shows when they were last changed, and continued use of the Service after a change means you accept the new terms.
